  • Except as may be the result of standard search engine or internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or using or launching any unauthorised script or other software.

  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.

  • Use the Services in a manner inconsistent with any applicable laws or regulations.

Additional prohibitions

  • Accounts & identity: Sell or otherwise transfer your profile, create multiple or fake accounts to circumvent limits, bans, or offers, or impersonate any person or misrepresent your affiliation.

  • Automation & data capture: Use bots, scripts, or automated tools (including scraping or crawling), collect or harvest data about users without consent, or access the Services via VPN/proxy to evade regional or eligibility rules.

  • Security & interference: Attempt to probe, scan, or test the vulnerability of the Services; bypass, disable, or interfere with security or access controls; upload malware, harmful code, or macros; reverse-engineer, decompile, or disassemble any part of the Services; engage in any activity that could damage, disable, or overload the Services; or circumvent DRM, paywalls, or technical protection measures.

  • Commercial conduct: Use a buying agent or purchasing agent to make purchases on the Services; engage in bulk purchasing, reselling, or drop-shipping without approval; use the Services to advertise, solicit, or run promotions without consent; abuse discount codes, referrals, trials, or promotional offers; make fraudulent or abusive chargebacks; or submit false claims of defect, non-delivery, or unauthorised use.

  • Capture & copying: Copy, download, save, scrape, or export any content (videos, images, text — educational and marketing — PDFs, course files); record, screen-record, screen-grab, or rip streams, lessons, or site content; or use downloaders, browser plugins, bots, or any tools to capture content.

  • Reproduction & derivatives: Reproduce, distribute, publish, perform, display, or mirror any content, or create derivative works, adaptations, remixes, or translations of our content.

  • Redistribution & notices: Re-upload, repost, or share content on social media, marketplaces, or file-sharing sites, or remove, obscure, or alter copyright, trademark, or watermark notices.

  • Courses & access: Share, sell, or distribute course materials, downloads, or logins; share, sell, or transfer course files, templates, handouts, or login access; or record, copy, redistribute, or live-stream paid content or sessions.

  • Brand usage & passing off: Use Phenomenail™ content or brand assets for commercial purposes without written permission; frame, mirror, or deep-link to the Services without written permission; or frame, deep-link, or embed content to pass it off as your own.

  • AI & datasets: Use Phenomenail™ content or brand to train AI models without permission, or train, fine-tune, or feed any Phenomenail™ content into AI models or datasets.

  • Claims, competition & IP: Use our content to create competing courses, guides, or marketing materials; collect or mine content for databases, libraries, or inspiration boards; claim ownership of, or falsely attribute, Phenomenail™ content or ideas; infringe third-party IP (images, music, software, course content); or post medical or therapeutic claims about products or techniques.

Consequences of breaching this Policy

The consequences for violating our Policy will vary depending on the severity of the breach and the user's history on the Services.

We may, in some cases, give you a warning; however, if your breach is serious or if you continue to breach our Legal Terms and this Policy, we have the right to suspend or terminate your access to and use of our Services and, if applicable, disable your account. We may also notify law enforcement or issue legal proceedings against you when we believe that there is a genuine risk to an individual or a threat to public safety.

We exclude our liability for all action we may take in response to any of your breaches of this Policy.
